This Privacy Policy (Policy) applies to your personal data and any other information that you may reveal or that DeafMatrix may collect whenever you engage with the App or our site. DeafMatrix shall endeavor to make all information that it collects secure and this Privacy Policy shall thus govern the collection, usage, sharing and storing of any information it gathers for its legitimate use. Personal information as used in this policy means the information relating to your device, posts, preferences and profile information.
This site/App may employ the use of Cookies, Log files, and Web beacons, tags and pixels to collect information on viewer traffic.
1.1 DeafMatrix collects all information that is associated with your account and use of our services that include your profile information, Facebook account’s information where you register to our services using your Facebook account, your preferences and device information.
1.2 The information we collect may be grouped into three different categories, that is, Information that You Give Out, Information We Get from Other Sources, and Information Generated during Your Usage of our services.
1.3 During the registration of an account with us you will feed in personal information relating to your identity, personality, sexual preferences, gender, religion, ethnicity, tribe, race and related information. This information will be collected and stored in our system.
1.4 You may equally give similar information whenever you participate in our surveys, promotions, contests, focus groups, responses, events or other services that require you to give out personal information that will be stored in our servers.
1.5 Your information will also be collected whenever you engage our support or customer care department, whether to complain about other users or on personal initiative. Additionally, your chats with other users, your posts and contents that you post will be collected and stored by us.
1.6 Other users may contact DeafMatrix about your profile and may supply some information about you that will be stored by us. Besides, by logging in using your Facebook account, you will be sharing your Facebook account’s information including your login details.
1.7 Lastly, DeafMatrix will collect data relating to your use of our services including the pages you access, links, people you interact with, searches, clicks, date and time you logged in, duration and related data. DeafMatrix will equally collect your device information including cookie settings, wireless access points and names, IP address, browser type, version and language, app crashes, operating systems and time zone. You may also permit DeafMatrix to collect information related to your location information through various means such as Bluetooth, GPS or Wi-Fi connections.
2.1 DeafMatrix shall use cookies and other technologies to be able to recognize you and the device you are using. Such use shall be primarily for our legitimate business interest in ensuring that our services are available to you. In particular, the cookies will help to authenticate you, retain your settings and preferences, analyze traffic and trends as well as gauge the effectiveness of advertisement campaigns.
3.1 DeafMatrix shall use your information to deliver its services to you, to enforce its legal rights, to ensure your safety and any other legitimate purpose including running of advertisements. DeafMatrix shall not unlawfully use your information by selling it to third-parties or unlawfully disclosing it.
3.2 Your information such as personal information will be used to administer your account by creating and managing your account, providing customer support and communicating our services to you.
3.3 We will use your profile information such as preferences to help match you and recommend you to other users as well as display your profile to others and vice versa.
3.4 The cookies data and device data that we collect will be used to help authenticate your account; allow consistency of our services whenever you use different devices or browsers, and enhance the efficiency of our services to you.
3.5 We may use the information we gather to help in developing, displaying and tracking content and run advertisement based on your preferences.
3.6 The information we gather on your usage of our services will be used for research and analysis on users’ behavior to help us to improve the services we offer and our content or features.
3.7 We shall equally collect and retain your data to help in the prevention, detection and fighting fraud, crime or other related illegal and unlawful conduct.
3.8 DeafMatrix will also use your information in ensuring that we comply with the requirements of the governing laws, help law enforcers or to enforce and/or exercise our rights.
4.1 DeafMatrix will not share your information unless it is intended to aid your use of our services or for other legitimate interests and legal purposes. We may therefore share your information with other users to aid in connection, with service providers and legal authorities.
4.2 Your posts and profile information will be shared to other users as well as other public information that you voluntarily share. We however encourage you to exercise care and caution on the kind of information that you make available on your profile since the same is subject to abuse and misuse by other users.
4.3 DeafMatrix may from time to time enlist third-party service providers to ensure that we deliver to your satisfaction. This may include those we engage to host and manage our data, advertising, analytics, customer care, payment processing, marketing, and security operations. DeafMatrix shall therefore share your information with these third-parties only for the purposes of ensuring the smooth delivery of our services to you.
5.1 DeafMatrix will only disclose your personal information where you consent or when required by law or law enforcement agencies in order to comply with applicable laws and regulations, in response to a subpoena, search warrant or other lawful requests for information we receive or in order to enforce our rights if you violate our Terms of Service.
5.2 We may equally disclose your information so as to enforce our right and protect our interest including where such disclosure will help diminish our liability and/or losses in an actual or threatened lawsuit, enforce this contract and any other agreements, protect other users and our business interests, and to help in investigating, preventing and/or take action for illegal activity, unauthorized conduct or suspected fraud.
6.1 Such sharing of information and disclosures of your information as already discussed in clauses 4 & 5 above may involve cross-border transfers across the United States and beyond the European Economic Area (EEA). In such cases, we will employ standard contractual clauses to safeguard your privacy.
7.1 You remain in total control of the information you share on your profile and you may access and update it or modify the same using our service tools in the App.
7.2 You may allow or reject push notification by changing your device settings to consent or decline the collection of certain information as well as their display.
7.3 You may delete your account and information on your profile and such information will no longer be available to the public.
8.1 You have the right to access, review and modify, right of portability or variation as well as a right to request that a copy of the information we collect and a report on how the same is used. You may request this by sending us an email or by reaching out to our support team.
8.2 You have a right to ask that your information be updated and rectified if you believe that such information held by us is inaccurate or that we are not entitled to retain the same. You may equally seek deletion, or object the processing of your information by us.
8.3 DeafMatrix reserves the right to reject/refuse or decline requests where it believes that such a request is unlawful, or where the same infringes on trade secrets and/or intellectual property or privacy rights of other users.
8.4 Where a request involves the disclosure of the chats with other users or information about other users, that user must give their consent by contacting our Privacy Officer and providing their consent in writing before such information can be disclosed.
9.1 Users in the UK and EU have the rights under the applicable EU regulations including the right: to be informed on the data collected, right of rectification, to erase personal data, to restrict processing, to object to decisions based on automated processing or profiling, to request for a copy of the data you have provided to us in a structured, machine-readable format and port the same to another data controller. You equally have the right to obtain a copy of or access to safeguards that we have employed when sharing your personal information outside the European Economic Area.
9.2 You also have the right to raise a complaint with data protection regulators including the Information Commissioner’s Office (ICO) for those in the United Kingdom.
10.1 Users from California are entitled to all rights already discussed above and those specifically provided for under the California Consumer Privacy Act. You may request that we disclose the categories of personal information that we have shared with third parties over the past twelve (12) months for the purposes of direct marketing by the third parties. We shall respond to your request within 30 days of receiving the same. We kindly implore your patience during this period.
11.1 DeafMatrix will take all reasonable precautions and follow what we believe are commercially reasonable practices to ensure the safety of your personal information. These shall include measures that ensure that your personal information is not inappropriately lost, misused, accessed, disclosed, altered or destroyed. We do not however promise, represent or warrant that your data will always remain secure.
11.2 DeafMatrix undertakes to routinely monitor our service and systems for possible vulnerabilities and attacks and update our systems accordingly. We shall also review how we collect, store and process our information on a periodic basis and update our security measures.
11.3 DeafMatrix will at any time and without notice suspend partially or wholly its services where it believes, suspects or has detected a serious breach to the security of users and its data. Users are encouraged to report to us immediately they suspect that their account has been hacked or there has been unauthorized access.
12.1 DeafMatrix shall retain your data only as long as it is relevant for its legitimate interests and as is authorized under the applicable law. We shall therefore hold on your data for up to three months (safety period) after you have deleted your account in order to ensure the safety and security of other users. During this period, no user may access the information on our services.
12.2 We will delete or anonymize your information after the safety period of three months unless:
(i) The law requires it to be kept as is the case with traffic data which may be kept for up to one year to comply with statutory obligations on data retention;
(ii) Where the data is kept to act as evidence of our compliance with the law such as records of consents to our Terms, Privacy Policy and related consents that are kept for five years;
(iii) There are issues that are outstanding or claim or dispute that require the said data to be kept until the issue or claim is resolved; or
(iv) The information is kept for our legitimate business interest including the prevention of fraud, ensuring safety of users and the security of our systems.
13.1 Our services are restricted and only persons who are eighteen (18) years old and above may use our services. DeafMatrix does not permit users under the age of 18 to use our platform and any user with such account will immediately be suspended and their account deleted. We do not knowingly collect personal information related to users who are under the age of 18 and you are encouraged to report to us whenever you suspect that a user is under the age of 18.
14.1 DeafMatrix reserves the right to modify this Privacy Policy at any time, and from time to time in order to reflect changes to our practices or for other operational, legal or regulatory reasons. Changes and clarifications will take effect immediately upon their posting on the website.
14.2 If we make material changes to this Policy, we will notify you here that it has been updated, so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we use and/or disclose it.
